01Agreement to These Terms
Welcome to Bang the Over. These Terms of Use ("Terms") govern your access to and use of the website located at bangtheover.com and any related pages, content, features, and services we provide (collectively, the "Site"), which is operated by Bang the Over ("Bang the Over," "we," "us," or "our").
By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, do not access or use the Site. 02Eligibility and Age Requirement

We may investigate and take appropriate action against anyone who, in our sole judgment, violates these Terms, including removing content, suspending or terminating access, and reporting the matter to law enforcement.
07Registration and Account Security
Certain features may require you to register or create an account. If you create an account, you agree to provide accurate and complete information and to keep it current. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use of your account. We may suspend or terminate your account at our discretion, including if we believe you have violated these Terms.
08User Content and Submissions

To the fullest extent permitted by law, Bang the Over and its owners, officers, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or gambling losses, arising out of or relating to your use of or inability to use the Site, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Site or these Terms will not exceed one hundred dollars ($100.00). Some jurisdictions do not allow the limitation or exclusion of certain damages, so some of the above limitations may not apply to you.
16Indemnification
You agree to indemnify, defend, and hold harmless Bang the Over and its owners, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or relating to your use of the Site, your User Content, your violation of these Terms, or your violation of any applicable law or the rights of any third party.
17Dispute Resolution, Arbitration, and Class Action Waiver
Please read this section carefully. It affects your legal rights and includes a binding arbitration provision and a waiver of class actions and jury trials.
Informal resolution first. Before initiating any formal proceeding, you agree to contact us using the information in Section 22 and to attempt in good faith to resolve the dispute informally for at least thirty (30) days.
Binding arbitration. If the dispute is not resolved informally, you and we agree that any dispute, claim, or controversy arising out of or relating to the Site or these Terms will be resolved by final and binding arbitration administered by a recognized arbitration provider under its applicable rules, rather than in court, except that either party may bring an individual claim in small claims court. The arbitration will take place in Spokane County, Washington, or another mutually agreed location, and may be conducted by telephone or video where permitted.
Class action and jury trial waiver. You and we agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. You and we each waive any right to a trial by jury.
Your right to opt out. You may opt out of this arbitration agreement within thirty (30) days after you first accept these Terms by sending written notice to the contact in Section 22 that clearly states your intent to opt out. If you opt out, the governing law and venue provisions in Section 18 will apply to your disputes.
This section is governed by the Federal Arbitration Act. If any portion of this section is found to be unenforceable, the remainder will remain in effect to the extent permitted by law.
18Governing Law and Venue
These Terms, and any dispute arising out of or relating to them or to the Site, are governed by the laws of the State of Washington, without regard to its conflict of laws principles. Subject to Section 17, you agree that any action not subject to arbitration will be brought exclusively in the state or federal courts located in Spokane County, Washington, and you consent to the personal jurisdiction and venue of those courts.
19Termination and Modification of the Site
We may modify, suspend, or discontinue the Site or any part of it at any time, with or without notice. We may also restrict, suspend, or terminate your access to the Site at any time, with or without cause and with or without notice. Provisions that by their nature should survive termination will survive, including those concerning intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution.
20Changes to These Terms
We may update these Terms from time to time. When we make changes, we will revise the "Last updated" date above. If we make material changes, we may provide additional notice, such as by posting a notice on the Site. Your continued use of the Site after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the changes, you must stop using the Site.
21General Provisions
These Terms, together with the Privacy Policy and any other policies referenced here, constitute the entire agreement between you and us regarding the Site and supersede any prior agreements on that subject. If any provision is found to be unenforceable, the remaining provisions will remain in full force, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable. Our failure to enforce any provision is not a waiver of our right to enforce it later.
You may not assign or transfer these Terms without our prior written consent, and any attempt to do so is void. We may assign these Terms freely. Nothing in these Terms creates any agency, partnership, or joint venture between you and us. The Site is controlled and operated from the United States, and we make no representation that the Site is appropriate or available for use in other locations. Section headings are for convenience only and do not affect interpretation.
